Court for Construction Sector Soon?

construction_courtPETALING JAYA: A specialist court dedicated for the construction industry is in the works according to the Construction Industry Development Board (CIDB).

 

CIDB chief executive Datuk Seri Dr Judin Abd Karim said that the board was setting up a Construction Court as a response to demands for a dedicated channel to resolve disputes in the industry.

"We worked with the Bar Council and industry leaders to initiate discussions on the setting up of a specialised court which will focus on resolving complex and technical construction sector disputes," Dr Judin said in a media release.

CIDB said the establishing of the court was vital for the sector as speedy dispute resolutions often required knowledge of industry intricacies and technical complexities.

"As such, judges who are dedicated to hearing construction cases will be more versed in the technicalities of the industry and will be able to provide swifter and more effective resolution to cases," it said.

If gazetted, Malaysia will be the second country in the world, after Britain to have established a specialist court for the construction sector.

The board said justice in the construction sector would be best served by construction arbitration, statutory adjudication and the specialist construction court.
