Nasha Aziz Withdraws Appeal on Paying Damages to Father

PUTRAJAYA, 8 FEBRUARY, 2012: Actress-cum model Nasha Aziz withdrew her appeal at the Court of Appeal here today against the decision of the Kuala Lumpur High Court to order her to pay RM10,000 in general damages to her biological father, Abdul Aziz Mohd Ali.


A three-man panel chaired by Datuk Zainun Ali consequently struck out the appeal.


The other two judges sitting on the panel were Justices Datuk Ramly Ali and Datuk Zaharah Ibrahim.


Earlier, Nasha's lawyer Siti Maspuah Maulan informed the panel of the withdrawal of the appeal against the Oct 9 2009 High Court decision in allowing Abdul Aziz's application for the court to enter judgment in his defamation suit against his daughter following the absence of her previous counsel at the hearing of the suit.


However, no reason was given for the withdrawal.


The High Court had also ordered Nasha, 40, to pay interest of eight per cent a year to her father, from the date the suit was filed, which was March 31, 2005, until disposal of the suit.
 
   
Abdul Aziz, 63, a silat teacher, had sued Nasha, whose real name is Noraishah Abdul Aziz, over an article in the Mingguan Malaysia newspaper which alleged that he was not her real father.


In his statement of claim, Abdul Aziz said that he is Nasha's natural father and that the defamatory words in the article, headlined "Jangan tanya hal peribadi", in the Nov 24, 2004, issue had caused him suffering and embarrassment and damaged his reputation.


He sought damages, interest, costs and other relief deemed fit by the court, claiming that the article meant or implied that he had died.


Nasha, in her statement of defence, said that the term "bapa" (father) in the newspaper article referred to an uncle, Abdul Aziz Hathim, who had raised her.


The actress did not deny that Abdul Aziz is her real father but said she regarded the uncle as the father in her life.


Outside the court, lawyer M.Visvanathan representing Abdul Aziz said following the withdrawal, the High Court's decision in awarding general damages to his client stays.
